Info we collect

1.  Introduction

This Privacy Policy applies to Angle Auto Finance Pty Ltd (ACN 161 130 696) trading as Angle Auto Finance of Level 23, 400 George Street, Sydney, New South Wales, 2000 (“we”, "us" or “our”). However, this Privacy Policy does not apply to the equipment finance business of Angle Finance.

Our Privacy Policy describes how we collect, use, store and disclose your personal information and comply with the obligations under the Privacy Act 1988 (Cth) (the "Privacy Act").

2.1   Customers or potential customers

If you are a customer or potential customer, we collect information about you and/or your spouse, partner or joint applicant, such as:

  • identification information (such as your name, address, age or date of birth, driver’s licence, passport or Medicare number);
  • contact details (such as email address, telephone number, residential address and postal address, if different to your residential address);
  • financial or payment information such as bank account details;
  • details of the finance-related products and services we have provided to you or that you have enquired about, including any additional information necessary to deliver those products and services and respond to your enquiries;
  • information about your financial and personal circumstances to substantiate your financial capability, such as payslips, income tax returns, business activity statements (for sole-traders or if you are self-employed), and other information on assets you own and any debts or other liabilities you might have;
  • other credit information including credit reports (as detailed in our Credit Reporting Policy);
  • information you provide to us in customer surveys or competitions; and
  • any additional information about you that you provide to us directly through our website or indirectly through your use of our website or online presence or through other websites or accounts from which you permit us to collect information (see section 3 below for more information).

If applicable, we may also collect health information that you provide to us (for example, if you make a consumer credit hardship request related to a health condition). We will treat this information as required by law.

2.2  Businesses and car dealerships

If you, or your employer, have any dealings with us, we may collect information about you to facilitate those arrangements, such as your name, position, contact details, or any other information you provide.

2.3  Employees, individual contractors and job applicants

If you are an employee of ours, you have an individual contract with us or if you apply for a job with us, we collect additional information about you to administer your employment or contracting engagement and to process your application (including qualification and identification information, residency / visa status information, medical records and health information, psychological testing results and results from relevant records checks). We may collect this information from you, or third parties such as recruiters, employers or contracting organisations and others. If you are offered employment or engagement as a contractor, we may also collect further details such as information about your emergency contact person (including their name, contact details and relationship to you), your tax file number, bank account number, superannuation and union membership details.

3.1  Directly from you

In many instances, we collect personal information directly from you. For example, if you are a customer, we may collect your information from an application form you have completed, when you use any features on our website or when you contact us by phone, email, or through our website. Your calls to us may also be recorded and monitored for training, verification and compliance purposes.

You do not have to disclose personal information to us. However, if you do not provide certain information we request, we may not be able to process or accept your application for credit, consider your application for employment, or otherwise provide you with services. We also may not be able to verify your identity or protect against fraud.

3.2  From an applicant

In the case of a joint application for our products or services we may collect information about you (such as information relating to your expenses and income) from a joint applicant for our products and services. For example, we may collect information about you from your spouse or partner if you jointly apply for credit from us.

If you provide information about your spouse, partner or joint applicant to us, you must ensure that they have read this Privacy Policy, our Credit Reporting Policy and any other privacy collection notice, privacy statement or privacy consent form that we provide to you in relation to your joint application.

In the case of an application on behalf of a business we may collect information from the applicant on individuals that are relevant to that business (such as directors, owners, shareholders, beneficial owners or the beneficiaries or trustees of a trust that is relevant to that business).

3.3  From our service providers and other third parties

If you are a customer or potential customer, we may collect information about you through our service providers and third parties that we deal with, including car dealerships and salary package providers who provide customer acquisition and onboarding services to us and with other third parties that refer or introduce you to us.

We may also collect information about you from other third parties as described above, and also from your employer, credit reporting bodies, government agencies and regulators and other third party service providers.

3.4  Through other means (website, cookies)

We may collect information about you through other means. Some of this information may not identify you, but if you are reasonably identifiable from the information that we collect then we will handle this information in accordance with the Privacy Act.

When you visit our website:

We may collect certain information such as browser type, operating system, website visited immediately before coming to our site, etc. This information may be used in an aggregated manner to analyse how people use our site, such that we can improve our service.

We may from time to time use cookies on our website. Cookies are very small files which a website uses to identify you when you come back to the site and to store details about your use of the site. If you are a customer or potential customer of ours, we may collect, hold, use and disclose your personal information:

  • to consider your creditworthiness (as set out in more detail in our Credit Reporting Policy);
  • to arrange or provide credit to you (including to act on your instructions and to administer and complete your transaction);
  • to manage that credit (including to assess hardship applications and to collect overdue payments);
  • to create and use an internal credit tool or otherwise procure our own assessments and ratings in respect of yours and other third parties credit worthiness, which may also take into account your information we obtain from you and other sources;
  • to communicate with you and to respond to your enquiries and resolve complaints and disputes;
  • to send you (either directly or through our service providers acting on our behalf) marketing and promotional messages and other information that may be of interest to you including industry updates;
  • for the purpose of customer surveys, contests and other promotional activities or events;
  • to facilitate, improve and optimise our services/operations and our customers’ experience (for example, by performing analytics and conducting research for advertising and marketing); and

If you, or your employer, have any business dealings with us, we collect, use and disclose information about you for the purpose of those business dealings.

If you apply for a job or contracting role with us, we collect, use and disclose information about you for the purpose of considering your application. If your application is successful, we collect, use and disclose information about you for the additional purpose of managing your employment or contracting relationship with us, including to pay your wages and fees. If your application is unsuccessful, we may retain your information in order to consider if you might be suitable for other roles with us in the future and to contact you in relation to possible future roles.

  • any third parties who acquire any rights or interests in any amounts or debts that you owe to us (including if we assign, transfer or novate your agreement with us);
  • the sponsors or promoters of any competitions that we conduct;

  • state and federal government agencies, regulatory bodies and law enforcement agencies or other persons as required or permitted by law.

5. Overseas disclosure

We may disclose your information to entities outside of Australia. These entities include our related entities and service providers located in the United States of America, the Philippines and India.

We only disclose your information to entities outside of Australia for our business functions or for the purposes of providing services to you. Where we do so, we ensure that the disclosure of and access to that information is secure and appropriate controls are in place.

Angle Auto Finance maintains strict procedures and standards and takes all reasonable care to prevent unauthorised access to, and modification and disclosure of, your personal information. We also take all reasonable care to protect any personal information we hold against misuse or loss.

We may store your personal information in paper or electronic form. If we no longer need your personal information, we will take steps to either destroy the information or de-identify it.
